Sexual Offenses, 家庭暴力, Dating Violence and Stalking Policy
BG大游 affirms respect, responsibility, and care between all persons. A sexual offense can occur between individuals who know each o的r, have an established relationship, have previously engaged in consensual sexual activity, and between individuals who do not know each o的r. A sexual offense can be committed by persons of any sex, sexual orientation and/or gender identity or expression.
“Dating Violence” is violence committed by a person (a) who is or has been in a social relationship of a romantic or intimate nature with 的 victim; and (b) 在哪里 的 existence of such a relationship shall be determined based on a consideration of 的 following factors: (i) 的 length of 的 relationship; (ii) 的 type of relationship; and (iii) 的 frequency of interaction between 的 persons involved in 的 relationship.
“家庭暴力” is violence committed (a) by a current or former spouse or intimate partner of 的 victim; (b) by a person with whom 的 victim shares a child in common; (c) by a person who is cohabitating with, 或与…同居, 的 victim as a spouse or intimate partner; (d) by a person similarly situated to a spouse of 的 victim under 的 domestic or family violence laws of 的 jurisdiction in which 的 crime of violence occurred; or (e) by any o的r person against an adult or youth victim who is protected from that person’s acts under 的 domestic or family violence laws of 的 jurisdiction in which 的 crime of violence occurred.
“Stalking” is engaging in a course of conduct directed at a specific person that would cause a reasonable person to (a) fear for his or her safety or 的 safety of o的rs; or (b) suffer substantial emotional distress.

Consent must be ongoing, and it may be withdrawn at any time. Consent cannot result from 的 use of coercion, intimidation, force, or threats. 不能从没有能力给予同意的个人取得同意,因为该人:
Incapacitation is a state in which an individual is unable to make informed, rational decisions because 的y lack 的 capacity to understand 的 “who, 什么, 当, 在哪里, why or how” of a situation or interaction. Individuals cannot give consent if 的y cannot understand 什么 is happening, 或者他们迷失了方向, 无助的, 睡着了, or unconscious for any reason. That applies even if alcohol or drugs were voluntarily consumed.

Anyone who has experienced 约会暴力, 家庭暴力, stalking or a sexual offense is strongly urged to report it to University officials, local law enforcement or both. Reports to University officials may be directed to:

When you report a sexual offense, an incident of 约会暴力 or 家庭暴力, 或跟踪, University officials will inform you in writing of your rights, 选项和 资源 您可以使用. You will receive an explanation of how to file a complaint with local law enforcement if you choose and how 公共安全 can assist you with that process; 的 University 政策 and procedures for sexual offense complaints; interim actions and measures that may be 您可以使用; and information about 的 importance of preserving evidence for proof of criminal sexual offenses or for obtaining a protective order.
If you report to 公共安全, 公共安全 will notify University officials who have a need to know, 他们将以公正的方式收集信息,并将有助于保存相关证据. The steps 公共安全 takes may vary depending on 的 circumstances and your needs.
Appropriate interim actions and measures are determined on a case-by-case basis, 可能包括, but are not limited to 的 following: issuing a no-contact order, 改变类, assigning an individual to a different lab or o的r clinical setting, and reorganizing housing assignments.

Examples of retaliation include, but are not limited to: harassment or bullying by 的 accused student or 的 accused student’s friends or peer group; pressure on 的 complaining student to drop 的 complaint; making a negative education decision against a person who has filed a complaint; or threatening a person with physical harm or legal action. 任何从事上述行为的人都可能受到报复和制裁.
